Legal opinion on the WTO conformity of an EU export ban on chemicals prohibited in the EU

Pesticide companies take advantage of loopholes in European legislation to continue producing and exporting thousands of tonnes of banned pesticides to poorer countries where regulations are weaker and less strictly enforced. This is what we showed in an investigation published in 2020, which made the headlines and resulted in the European Commission committing to present a proposal to ban this practice.

This legal opinion commissioned by Public Eye and Corporate Observatory Europe (CEO) to Andrea Hamann, Professor of Law at the University of Strasbourg and expert in international dispute settlement and World Trade Organization (WTO) law, shows that adoption of an export ban on hazardous chemicals banned in the European Union (EU) would be compatible with WTO rules.
